NOTE: THESE TERMS OF USE ARE ONLY VALID FOR USERS LOCATED IN TURKEY. IF YOU USE THE APPLICATION OUTSIDE TURKEY, DIFFERENT TERMS OF USE MAY APPLY DEPENDING ON YOUR LOCATION. THE APPLICATION DISPLAYS THE TERMS OF USE APPROPRIATE FOR YOUR LOCATION.

1. Definitions
The company located at Parsana, Boğazköy Sk, 42250 Selçuklu/Konya address and referred to as "INTERMEDIARY" in this agreement shall be called "Neyiyek.com".
Customer: The person who creates a request to order goods or services through the Application.
Party(ies): Customer and/or Neyiyek.com.
Terms: All of these terms of use.
Application: The mobile application or web-based software owned by Neyiyek.com that allows ordering products and services offered by Neyiyek.com via mobile devices and other internet-connected devices.
Agreement: The distance sales contract established between the Parties in accordance with the Pre-Information Form and the information contained therein.
Product(s): The goods or services selected by the Customer via the Application and offered by Neyiyek.com in the delivery regions served by Neyiyek.com.
Business Place (Restaurant): The sellers listed within Neyiyek.com in the Application.
2. Application and Membership
2.1. Users; can start using the Application under these Terms after downloading the Application, filling in the required registration fields, verifying their GSM number, and creating their password.
2.2. The Customer accepts that all information provided during the application is complete, accurate, and up-to-date. This information can be updated at any time via the Application.
3. Use of the Application
3.1. Neyiyek.com provides delivery service in specific service regions where orders can be placed via the Application. When the Customer selects a delivery address in the Application, only products suitable for that region are displayed.
3.2. The delivery time shown in the Application is an estimate and is not binding. Neyiyek.com cannot be held responsible for delays.
3.3. The sales price, delivery fees, transportation costs, and all taxes and additional expenses are collected from the payment method chosen by the Customer as specified in the Agreement.
3.4. When the Customer chooses the Online Payment Method, they enter their card information once; this information can be used for subsequent transactions without re-entering. The online payment infrastructure is provided by MasterCard. Neyiyek.com only stores the first six and last two digits of the card. The Customer can register multiple cards.
3.5. If the Customer wishes to give a tip to the courier via the Application, they can complete the transaction on the payment screen by selecting or entering the tip amount. The tip is entirely optional and based on customer satisfaction. The entire tip is paid to the selected courier. Neyiyek.com is only in the position of an intermediary.
3.6. By clicking the "Send" button after selecting the tip amount, the Customer;
(i) agrees to give the specified amount to the courier and
(ii) accepts that Neyiyek.com may collect this amount from the card used for the order or another selected card. Tip payments cannot be canceled.
3.7. The Customer accepts that the relevant legal provisions will apply in case of unlawful use of their card by third parties.
3.8. In case of loss or theft of the Customer's device, third parties cannot access the card information registered in the Application; however, the Customer must inform Neyiyek.com and stop the use of the card. Otherwise, Neyiyek.com is not responsible for any orders that may occur.
3.9. The Customer is entirely responsible for the security of the username, password, etc. used to access the Application and should not share payment information with third parties.
3.10. The Customer's payment obligation is deemed fulfilled upon payment to Neyiyek.com. Except for tips, no additional fee is requested during or after delivery.
3.11. The Customer; will be informed about delivery, payment, cancellation, and right of withdrawal within the scope of the Agreement.
3.12. Products are delivered to the address specified during the order. The address cannot be changed later. If the Customer or the recipient is not at the address or if the address is incorrect, Neyiyek.com is not responsible and is deemed to have fulfilled its obligation. Costs arising from delays or non-delivery due to the Customer belong to the Customer.
3.13. From time to time, sales related to social responsibility projects may be made. Unless otherwise stated, these products are delivered to the relevant institution, not to the Customer, and may not be subject to the right of withdrawal.
3.14. Complaints can be submitted to info@Neyiyek.com.
3.15. The Customer agrees to use the Application in a lawful and responsible manner. Neyiyek.com is not responsible for the Customer's unlawful transactions.
3.16. Neyiyek.com cannot be held responsible for the inability to use the service due to technical problems caused by the Customer.
3.17. It is accepted that all orders are for personal use and cannot be resold.
3.18. Tobacco and alcoholic products are not sold via the Application; the Customer agrees not to order these products.
3.19. Orders are prepared and delivered according to the delivery method chosen by the relevant business place. The invoice or receipt is issued by the business place.
3.20. Refund; is made in limited cases such as failure to deliver the order, stock problem, excessive delay, defective/faulty product, or dissatisfaction with the approval of the business place.
3.21. Refund methods vary according to the payment type. Card refunds are subject to banks' processes.
3.22 & 3.23. In case of delivery of wrong or missing products and if an invoice has been issued, the refund invoice must be sent to Neyiyek.com.
3.23. (The numbering repetition in the original text is preserved) Product availability is limited to the business place stocks at the time of order.
3.24. In case of price or product information errors, Neyiyek.com may correct or cancel the order by informing the Customer. Neyiyek.com is not responsible for errors originating from the business place.
3.25. Comments made after 06.04.2022 may be published by Neyiyek.com.
3.26. The Customer is responsible for the accuracy, legality, and appropriateness of the shared comments and content.
3.27. Comments that are unlawful or contrary to the Terms may be removed. The accounts of users who abuse the comment/rating system may be suspended or deleted.
3.28. Harmful, illegal, insulting, spam, threatening, misleading, infringing, or irrelevant promotional content cannot be shared.
3.29. The Customer declares that the content they share is lawful and does not infringe the rights of third parties.
3.30. Campaigns may be personal, regional, instant, or limited. Restrictions may be applied to prevent abuse.
3.31. There may be third-party links in the Application. Neyiyek.com is not responsible for this content.
3.32. The member can delete their account. Reopening an account with the same phone number may prevent access to previous campaigns.
7. Protection of Personal Data
7.1. Neyiyek.com values the protection of personal data. Relevant documents can be accessed via links.
7.2. Only one GSM number can be defined for a user. To change the number, a new account must be created.
7.3. The Customer accepts that the shared personal data belongs to them or that they have permission to share it.
7.4. Account deletion can be requested. Deleted accounts cannot be reactivated; there may be temporary restrictions for re-registration with the same number.
8. Termination
8.1. The Customer can stop using the Application at any time by deleting it. Neyiyek.com reserves the right to suspend or terminate services.
8.2. In case of actions contrary to the Terms or law, the account may be suspended or terminated.
8.3. Account suspension can be requested. Suspended accounts cannot be logged into; registered addresses and cards are deleted.
9. Intellectual Property Rights
9.1. All intellectual property rights belonging to Neyiyek.com are exclusively owned by Neyiyek.com.
9.2. These rights cannot be used for commercial purposes; they cannot be copied, distributed, or derivative works created.
9.3. Visual, written, and audio content in the Application cannot be reproduced without permission.
10. Changes
Neyiyek.com may change these Terms at any time by announcing them via the Application.
11. Force Majeure
Neyiyek.com is not responsible for the failure to fulfill obligations due to force majeure events such as natural disasters, technical failures, strikes, legislative changes, and similar.
12. Applicable Law and Jurisdiction
12.1. These Terms are subject to the laws of the Republic of Turkey.
12.2. For consumer disputes, consumer arbitration committees and consumer courts are authorized.
12.3. For non-consumer disputes, Konya Central (Selçuklu) Courts and Enforcement Offices are authorized.
13. Evidence Agreement
The Parties agree that Neyiyek.com records constitute valid evidence within the scope of the relevant legislation.
14. Restaurant Information
Restaurant owners registering on the site agree to provide the following information:
a. Telephone order numbers
b. Restaurant address
c. Trade name
This information is published on the restaurant's public page.
15. Neyiyek.com Restaurant Menu Terms of Use
Menu Addition and Update Policy
Restaurants are obliged to keep their menus up to date.
Updates can be made via the panel or by e-mail to info@Neyiyek.com.
Menu accuracy is the responsibility of the restaurant owner.
Neyiyek.com does not pull data from other sites.
Registration is deemed acceptance of these terms.
Menu data is stored securely.
Menu deletion request can be made at any time.
Updates are deemed accepted upon publication.

16. Effectiveness
The Customer is deemed to have accepted these Terms by downloading, registering, and using the Application.
Please read carefully. If you accept, you can benefit from all the advantages offered by Neyiyek.com. We wish you good cooperation!

PARTNER BUSINESSES' BEHAVIOR, ORDER, DELIVERY, CANCELLATION AND SANCTION POLICY
This policy regulates the rules that partner businesses providing services through the Neyiyek.com ("Neyiyek") platform must comply with in their relations with users, Neyiyek employees, field personnel, and logistics service providers, and the administrative and contractual sanctions that may be applied in case of violation of these rules.
This policy is an integral part of the partner business agreement and becomes binding upon acceptance by the partner business.
User: Real persons who create orders through the Neyiyek platform
The following actions by partner businesses and their employees are prohibited:
Engaging in insulting, threatening, coercive, degrading, harassing, intimidating, or similar behavior towards users, Neyiyek employees, field personnel, or couriers.
Harassing users by the following means:
Calling by phone after the order,
Sending messages,
Contacting via social media or similar digital channels,
Establishing direct or indirect communication due to comments or ratings.
Using user data for advertising, marketing, or promotional purposes or transferring it to third parties.
Sharing information and content regarding orders or users on social media, messaging applications, or similar platforms.
Responses to user comments should be polite, measured, and informative.
The use of profanity, insinuation, mockery, accusatory, threatening, or degrading expressions is prohibited.
User comments are evaluated within the scope of freedom of expression; a negative comment alone does not constitute a reason for sanction.
Partner businesses are obliged to accept or reject orders transmitted to them within periods appropriate to Neyiyek's operational standards.
Systematic or continuous rejection of orders, except for technical problems, stock insufficiency, or force majeure, is evaluated as a violation.
In cases where it is necessary to change the content of the order, this must be reported immediately through the Neyiyek system.
Orders must be prepared in accordance with the estimated delivery time specified on the platform.
Continuous and unjustified exceeding of the delivery time is considered a performance violation.
Unjustified waiting of couriers assigned by Neyiyek or third parties is prohibited.
In case of repeated waiting, Neyiyek may temporarily stop order routing or apply other sanctions.
Order cancellations occurring for reasons under the control of the partner business are evaluated weekly and monthly.
Cancellation rates reaching extraordinary levels may lead to the following sanctions:
Notification,
Performance warning,
Temporary suspension of order acceptance,
Termination of the agreement.
During the evaluation process, Neyiyek takes into account industry averages, the business's past performance, and cancellation reasons.
All products offered must comply with food safety, consumer protection, and hygiene legislation.
Sending expired, unsafe, unlabeled, or non-compliant products constitutes a severe violation.
Sanctions are gradually increased in case of repetition of similar violations.
The following actions are considered severe violations:
Creation of false orders, comments, or ratings,
Attempts to manipulate rating and ranking systems,
Actions aimed at harming competing partner businesses,
Misuse of campaigns, coupons, or system vulnerabilities.
If such actions affect user security or platform integrity, Neyiyek may apply temporary or permanent measures without prior notice.
Taking into account the nature of the violation, frequency of repetition, and impact on the platform, Neyiyek may apply one or several of the following sanctions:
Verbal or written warning,
Written official warning,
Suspension of order acceptance for a certain period,
Termination of the agreement.
In case of severe violations, Neyiyek may terminate the agreement immediately.
For other violations, termination may be pursued after applying graduated sanctions.
Except for severe violations, the partner business is given a reasonable time to submit a written defense. The submitted defense is evaluated by Neyiyek and a decision is made accordingly.
This policy may be updated by Neyiyek. Updates enter into force after being published on the platform and reasonable prior notice.
